TERMS OF SERVICE

Welcome to AELLA Activewear. This website is operated by Isabelle Ashcroft trading as AELLA Activewear. Throughout these terms, “AELLA”, “we”, “us” and “our” refer to this business.

These Terms of Service apply when you use our website or purchase our products. Please read them alongside our Returns & Exchanges Policy, Shipping Policy and Privacy Policy.

  1. YOUR CONSUMER RIGHTS

Our products come with consumer guarantees under Australian Consumer Law that cannot be excluded.

Nothing in these terms or our store policies excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified. If another provision conflicts with those rights, your statutory rights prevail.

For a major failure, you may choose a refund or replacement. You may also be entitled to compensation for reasonably foreseeable loss or damage. For other failures, we will provide the remedy required by law.

  1. USING OUR WEBSITE

You agree to use our website lawfully and to provide accurate, current information when placing an order or contacting us.

You must not interfere with the website’s operation, attempt to access accounts without permission, introduce harmful software or use another person’s payment details without authorisation.

If you create an account, please keep your login details secure and notify us if you suspect unauthorised access.

  1. PRODUCT INFORMATION

We aim to describe and photograph our products accurately. Colours may appear slightly different depending on your screen and display settings. This does not affect your right to receive products that match their description.

Please review the product description, size guide and care instructions before purchasing. Contact us if you need help choosing a size.

We may update our product range, descriptions and availability. These updates do not change the agreed details of an order we have already accepted.

  1. PRICES AND PAYMENT

All prices are displayed in Australian dollars (AUD), unless otherwise indicated. AELLA Activewear is not currently registered for GST and does not charge GST.

Any applicable shipping charges are displayed at checkout before you complete your purchase.

Prices and promotions may change. Changes do not affect orders we have already accepted.

Payment must be authorised and successfully processed before an order can be dispatched. You must be authorised to use the payment method provided.

Promotional offers may have additional conditions, which will be disclosed with the offer. Refunds for discounted items are based on the amount actually paid.

  1. ORDERS AND CANCELLATIONS

Please check your items, sizes, delivery address and contact details before submitting your order.

Your initial order confirmation acknowledges that we have received your order. We accept your order when we send your dispatch confirmation.

We may decline or cancel an order for a reasonable reason, such as unavailable stock, an obvious pricing error, unsuccessful payment or suspected fraud. We will notify you and refund any payment taken for the cancelled items and any associated delivery charges that no longer apply.

If you need to change or cancel an order, contact hello@aellaactivewear.com as soon as possible. We will try to help, but changes may not be possible once packing or dispatch has begun. Your statutory rights and our Returns & Exchanges Policy remain unaffected.

  1. SHIPPING AND DELIVERY

Our available shipping destinations, delivery charges and estimated dispatch and delivery times are described in our Shipping Policy and at checkout.

Delivery estimates may be affected by carrier delays, public holidays or circumstances outside our control. We will communicate significant delays that we become aware of.

If your parcel is delayed, missing or arrives damaged, contact hello@aellaactivewear.com. We will investigate with the carrier and work with you to resolve the issue in accordance with your legal rights.

Please provide a complete and accurate delivery address. If an address error you supplied results in additional delivery costs, we will explain those costs and agree on the next steps with you before arranging another delivery.

  1. RETURNS, SIZE EXCHANGES AND REFUNDS

If the size isn’t quite right, you may request a refund or size exchange within 30 days of receiving your order.

For sizing returns, items must be in perfect, original condition, unworn and unwashed, with tags attached. They must be free from stains, makeup, fake tan, deodorant marks, perfume, other odours and pet hair.

Customers cover return postage for sizing returns. Original delivery charges are not refundable for these returns. Exchanges are subject to availability, and any delivery charge for the replacement will be confirmed before you proceed.

Approved refunds are issued to the original payment method. We do not offer store credit.

The 30 day window and condition requirements for sizing returns do not limit your rights in relation to faulty, damaged, incorrectly supplied or otherwise noncompliant goods.

  1. PRODUCT CARE

Follow the care instructions supplied with your garment.

Damage caused by misuse or failure to follow appropriate care instructions may not qualify for a remedy. This does not exclude remedies for manufacturing faults or other failures covered by Australian Consumer Law.

  1. RELATIONSHIP WITH SHOPIFY

AELLA Activewear is powered by Shopify, which enables us to provide the website and related services to you. However, any sales and purchases you make in our store are made directly with AELLA Activewear.

By using these services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and AELLA Activewear, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with AELLA Activewear.

This section is subject to the consumer rights protections in Section 1.

  1. INTELLECTUAL PROPERTY

The website’s branding, photographs, text, graphics and other original content belong to AELLA Activewear or are used with permission from their owners.

You may browse the website and share links to our products for personal use. You must not reproduce or use our content for commercial purposes without permission, except where permitted by law.

  1. REVIEWS AND FEEDBACK

If you submit a review, it must reflect your honest experience and must not contain unlawful, abusive or misleading content.

By submitting a review for publication, you give us permission to display it, together with the display name you provide, on our website and in marketing materials. We may format or shorten a review without changing its meaning.

You retain ownership of your content. Please do not submit content that infringes another person’s rights.

  1. PRIVACY AND EXTERNAL SERVICES

We handle personal information as described in our Privacy Policy:

Our store uses Shopify and other providers to support functions such as payment processing and delivery. Their handling of information is explained in the relevant privacy policies.

Our website may link to external websites. Those websites have their own terms and privacy policies. Nothing in this section removes our responsibilities for the products or services we supply.

  1. WEBSITE AVAILABILITY AND LIABILITY

We take reasonable care in operating our website but cannot promise uninterrupted access. Maintenance, technical issues or external events may temporarily affect availability.

We remain responsible for our obligations under applicable law. Nothing in these terms excludes liability for our fraud, negligence or any liability that cannot lawfully be excluded.

You are not responsible under these terms for losses caused by our own acts or omissions.

  1. CHANGES TO THESE TERMS

We may update these terms to reflect changes to our business, services or legal obligations. The current version and its update date will appear on this page.

Changes will apply prospectively and will not reduce your rights for orders already placed. Where required by law, we will provide notice of material changes.

  1. GOVERNING LAW

These terms are governed by the laws of Western Australia and applicable Commonwealth laws.

Disputes may be brought before courts or tribunals with jurisdiction. This does not restrict any mandatory consumer protections or rights to bring proceedings available to you under applicable law.

If a provision is found to be unenforceable, the remaining provisions continue to apply to the extent permitted by law.
